- Pursuant to the April 26, 2002 Pricing Ordinance No. 40/2002/PL UBTVQH10;
- Pursuant to the Government's Decree No. 170/2003/ND-CP of December 25, 2003 detailing the implementation of some provisions of the Pricing Ordinance;
- Pursuant to the Decision No.886/QĐ-TCCB-LĐ of the Ministry of Transport and Communications dated May 12, 1993, on the establishment of the State Enterprise,

DECIDES:

Article 1.- To promulgate, together with this Decision, the Saigon Port's Table of Seaport Service Charges.

Article 2.- Subjects of Application of this Seaport Services Charges cover:

- Ships engaged in the transportation of cargoes (including containers) and/or passengers from Vietnam to foreign countries or vice versa, transit-Vietnam transportation, international transshipment; foreign army and training vessels entering/departing or mooring in maritime zone or water of Saigon Port;

- Cargoes (including containers), which are exported or imported, in transit or international transshipment by their carriers (or those authorized by the carriers) shall be paid by their carriers (or those authorized by the carriers);

- Passengers (including crew members and officers of passenger ships) entering Vietnam from foreign countries by sea or vice versa;

Article 3. The rates prescribed in the Saigon Port's Table of Seaport Service Charges are exclusive of VAT;

Article 4. The Saigon Port's relevant departments are to inform the cargo owners, ship owners, and concerning parties for executing duly payment. The Saigon Port's stevedoring companies are to execute the Decision accordingly.

Article 5. This Decision becomes effective from September 01st, 2005. The previous decisions contrary to this Decision are to be rendered null and void.

SAIGON PORT'S TABLE OF SEAPORT SERVICE CHARGES
(CHARGES ARE QUOTED IN U.S. DOLLARS)

To be promulgated under Decision No. 948/2005/QĐ dated 12 August 2005 by the Director General of Saigon Port

I. GENERAL PROVISIONS

1/. Subjects of Application:

1.1 Ships engaged in the transportation of cargoes (including containers) and/or passengers from Vietnam to foreign countries or vice versa, in-transit transportation, international transshipment (referred to collectively as international transports); foreign military ships, training ships entering/departing or anchoring at wharves/buoy berths under the management of Saigon Port or using services supplied by Saigon Port.

1.2 Cargoes (including containers), which are exported or imported, in transit or international transshipment by their carriers (or those authorized by the carriers) shall be paid by their carriers (or those authorized by the carriers).

1.3 Passengers (including crew members and officers of passenger ships) entering Vietnam from foreign countries by sea or vice versa.

2/. Working time:

Normal daily working times are from 07:00 am to 17:00 pm, the port workers execute handling in three consecutive shifts (including Sundays, holidays, and Lunar New Year days (Tet holidays).

3/. Units for calculating seaport service charges and round-up method:

Unit price of seaport service charges shall be calculated on the basis of gross tonnage (GT); main engine capacity shall be calculated in horse power (HP) or kilowatt (kW) of ships; time shall be calculated in hour or day; cargo volume shall be calculated in ton or cubic meter; containers shall be counted in unit; more concretely:

3.1 The tonnage unit:

3.1.1 For dry carriers (including container carriers), military ships and training ships: the tonnage for calculating seaport service charges is the maximum GT inscribed in the Certificates of Registration (decimals less than 0.5 GT ignored, from 0.5 GT to less than 1 GT shall be rounded to 1 GT.

3.1.2 For liquid cargo tankers: the tonnage for calculating seaport service charges is equal to 85% of the maximum GT inscribed in the Certificates of Registration, regardless of whether the ships have ballast water or separation water tank or not.

3.1.3 For ships on arrival or exit for passenger transportation, repair or dismantlement: the tonnage for calculating seaport service charges is equal to 50% of the maximum GT inscribed in the Certificates of Registration.
3.1.4 For ships without GT inscription: the tonnage for calculating seaport service charges shall be converted as follows:
- Cargo ships: 1.5 ton of registered tonnage is equal to 1 GT.
- Tug boats, push boats: 1 HP is equal to 0.5 GT.
- Barges: 1 ton of registered tonnage is equal to 1 GT.

3.1.5 For ships being a convoy of barges and tug boats (or push boats): the tonnage for calculating seaport service charges is the total GT of the entire convoy of barges and tug boats (or push boats).

3.2. The engine capacity unit: is horse power (HP) or KW; any odd of less than 1 HP (or KW) shall be rounded up to 1 HP (or KW).

3.3 The cargo volume (including packing) unit: shall be ton or cubic meter (M3); the odd part of under 0.5 ton or under 0.5 m3 shall not be counted, and of 0.5 ton or 0.5 m3 or more shall be rounded up to 1 ton or 1 m3. For one single bill of lading, the minimum volume for calculating seaport service tariffs shall be 1 ton or 1 m3. For cargoes, of which each ton occupies 2.0 m3 or more, every 2.0 m3 shall be calculated as 1 ton.

3.4 The time units:

- For time unit being day: a day is calculated with 24 hours; the odd part of 12 hours or less shall be calculated as 1/2 day, if the odd is over 12 hours, it shall be rounded up to 1 day.

- For time unit being hour: 1 hour is calculated equal to 60 minutes; the odd part of 30 minutes or less shall be calculated as 1/2 hour, if the odd is over 30 minutes, it shall be rounded up to 1 hour.

- A shift is calculated equal to 8 hours, 1/2 shift shall be calculated as 4 hours.

3.5 Currencies for calculating Seaport Service Charges: shall be collected in US dollar. The payment of seaport service charges shall comply with the Vietnamese State's current regulations on foreign currency management. In cases where it is necessary to convert US dollar into Vietnam dong, the conversion shall be made at the average exchange rate on the interbank foreign currency market, announced by the State Bank of Vietnam at the time of payment.

II. CHARGES ON WHARFAGE AND MARINE SERVICES:

1/. Rates for use of wharfs, anchorage, buoys in seaport areas:

1.1 Applied to transport means:

1.1.1 Ship berthing at wharf or anchoring at buoy shall pay wharfage at rates as follows:

- At wharf : 0.0029 USD/GT-Hour
- At buoy : 0.0012 USD/GT-Hour
1.1.2 In case ship takes many places within the port area: Wharfage shall be totally charged on actual time and rate at each berth.

1.1.3 In case a ship disregarding the order to leave the port continues to occupy berth or buoy, wharfage shall be charged at the following rates:

- Occupying of wharf: 0.006 USD/GT-Hour
- Occupying of buoy: 0.002 USD/GT-Hour

1.1.4 For ships of under 200 GT: wharfage shall be charged with a lumpsum of 50 USD/trip (in & out) within 5 days. Each subsequent day: 15 USD.

1.1.5 For ships berthed alongside another ship at wharf:

0.0017 USD/GT-Hour

1.1.6 In case a ship due to weather condition has to stop handling of cargoes for more than 1 day (24 consecutive hour) or has to give up its berth for another ship at the order of the port authority, wharfage shall be exempted for the period of no handling.

1.2 Applied to Passengers:
(Passengers including crewmembers and officers of passenger cruise or army ships and training ships)

1.2.1 passengers passing through the wharf/berth (on arrival or departure) shall be subject to wharfage at the following rates:

- On entry : 1 USD/person
- On exit : 1 USD/person
(Children under 12 year old are exempted for wharfage)

1.2.2 In case a ship allowed to berth at anchorage area using other facilities to transport passengers to shore for the purpose of sight-seeing, the wharfage applied to passengers shall be at the rate of 1.0 USD/person (entry and exit inclusive).

2/. Charges on tugboat assistances

2.1 Ships entering into/or departing from wharves/buoy berths under the management of Saigon Port with using tugboat assistances are subject to charges at the following rates:

The above rates applied for the period of all days (no additional charges for Sundays, holidays, Lunar New Year (Tet day).
2.2 Special cases:

· Increasing 30% of the rate in II/2/2.1:
- Shifting between wharves/buoys of Saigon Port in the area of Saigon river.
- Shifting between wharves/buoys of Saigon Port in the area of Saigon river and wharves/buoys of Ben Nghe Port and Tan Thuan Dong Port.
- Shifting between the ports of Lotus Port/Rau Qua and Tan Thuan II.

· Increasing 50% of the rate in II/2/2.1:
- Shifting between wharves/buoys of Saigon Port and wharves/buoys of other ports (in the area of Saigon river)
- Tugboat to escort ship from the nautical No.4 to wharves/buoys in the area of Saigon river, or vice versa, under the pilot's requirement.

· Increasing 100% of the rate in II/2/2.1:
- Shifting between buoys in the area of Nha Be and wharves/buoys in the area of Saigon river.

· Shifting in case of alteration of ship agents: same rate as for one time of entering (or departing from) the port.

· In case the tugboat has arrived on time at the meeting point as ordered by the ship agents, but with any reason the ship has not yet arrived, or does not arrive on time, or departure cancelled, or tugboat changed under the pilot's requirement: to be charged 50% of the rate in II/2/2.1

· Rates for tugboat assistances agreed between the Saigon Port Tugboat Services Co. (TUGSERCO) and shipowners (or ship agents) in the following cases:

- Ship's main engine is not in operations, using tugboats for towing or pushing.

- Tugboat services to ships entering, departing, or shifting between wharves/buoys not being under the management of Saigon Port, or from requirements of shipowners for tugboat services out of the area as above regulated; or tugboat services to ships entering (leaving) dry-dock for repairs.

3/. Charges on mooring/unmooring: (including facilities/means, if any, to support the mooring/unmooring works)

Rates for mooring and unmooring applied to one whole mooring and unmooring. For each mooring or unmooring separately, the above half rate shall be applied.

4/. Hire of canoe:

For transporting workers, passengers: 30 USD/Hour

5/. Charges on supply of fresh water:
Water supplied by order of the ship and at the rate as follows (including cost of facilities for water supply):

- By water pipelines from wharf : 2.50 USD/M3
- By waterways transport means : 3.50 USD/M3

6/. Charges on dumping services:

Ships whether berthing at wharves or at buoys shall have to dump garbage at least once every 3 days, charges for the first dumping service shall be done upon arrival of ship at wharfs/buoys at the following rates:

6.1 For cargo ships:

· Ship of under 200 GT:
- At wharf : 4 USD/Time/Ship
- At buoy, anchorage, bay : 8 USD/Time/Ship

· Ship of 200 GT to under 15,000 GT:
- At wharf : 15 USD/Time/Ship
- At buoy, anchorage, bay : 40 USD/Time/Ship

· Ship of 15,001 GT and above:
- At wharf : 30 USD/Time/Ship
- At buoy, anchorage, bay : 50 USD/Time/Ship

6.2 For passenger cruise, military ship, training ship:

- At wharf : 0.70 USD/person

. Minimum rate for one dumping of garbage: 100 USD/Time-Ship
. Maximum rate for one dumping of garbage: 500 USD/Time-Ship

- At buoy, anchorage, bay (or at wharf but waterway transport means shall be used for dumping of garbage): 130% of rate applied for ship berthing at wharf.

- In case of passenger ships operating in fixed route call at the port with minimum of 4 voyages each month, if having dumping services, rate for dumping garbage shall be 60% of rate applied for ship berthing at wharf.

6.3 Special cases:

- Ships carrying cargoes or passengers equipped with garbage disposal facilities and had processed disposal of garbage before dumping service, if having dumping services, 50% of the rate in II/6/6.1 and II/6/6.2 shall be applied.

- In case as required by the shipowner or by quarantine authority, garbage should be destroyed (burned, buried,...), the rate for dumping services shall be agreed between the director of dumping service company and its customer based on negotiation.

7/. Charges on opening, closing hatch:

Shipowner ordered the port workers to open/close the ship's cargo hatches is to pay charges at the following rates:

8. Charges on other services:

Shipowner requires the port to arrange workers for the following services:

- Sweeping, cleaning cargo holds
- Washing ship's deck
- Lashing cargoes
- Tallying, delivering/receiving cargoes
- Other services not mentioned above

Rates for the above services shall be agreed between shipowner and the port.

III. CHARGES ON HANDLING CARGOES, CONTAINERS

1/. Charges on handling cargoes (Except container):

1.1 Cargo group:

Group 1: All kind of cargo in bulk
Group 2: Cargoes in bags (except bags of agriculture and forestry products, polyethylene, paraffin wax described below)
Group 3: Assorted steel & iron in bundles/packages, coils, plates, bars.
Group 4: Machinery, equipment; cargoes in cases, packages, drums, cans, tanks such as fuel oil, grease, paint, asphalt, insecticide, chemicals,... flywoods, wood logs, timbers, bamboos with length of £12m (except factors mentioned in Group 6 below).
Group 5: All kind of assorted cargoes such as handicrafts, ceramics, bags of agriculture and forestry products, polyethylene, paraffin wax; food and industrial cargoes in all kind of packaging (except uncommon cargoes as specify detailed): household effects, sport appliances, stationary, paper in rolls, woodpulp, cotton, textiles, paper-bags, animal feathers, ceramics, glass, electrical parts, soap, cigarettes, fresh fruits & flowers, medicines, live animals, plants, etc.
Group 6: Bulky/heavy lifts bared or packed such as conveyor belts, construction steel beams, boilers, housing frames, and cargoes with one of these factors: weight of above 20MT to 30MT, or length of above 12M to 15M, or width of 2.5M to under 3.5M, or height of 2.5M to less than 3.5M
Cargoes of high values such as ginseng, deer antlers, foreign wine, alcohol, and cigarettes, swallow-nests, crystals, electronic devices, medical instruments.
Group 7: Means of transportation (under 30 tons)

* Other kinds of cargoes not above-mentioned are based on quality, packaging, handling rate to insert into equivalent group.

Note:

- In case of gearless ship or of order by shipowner to use the port's crane: beside the rates in III/1/1.2/1.2.1, charges on hire of crane prescribed in III/6 of this Table of Seaport Service Charges shall be added.

- Unloading or loading at buoy/anchorage: increase 10% of the above rates in III/1/1.2/1.2.1

- For the cargoes with high values not inserted in Group 6, the rates of unloading or loading shall be agreed between the port and its customers (Minimum rate shall has to be more than 10% of the rate of unloading/loading charges applied for Group 6).

- In case of cargoes unloaded or loaded with shipgears and by crewmembers on board the ship, the port workers undertake works on wharfside only: 50% of the rate prescribed for the mode of Ship's hold-Wagon/Truck/Barge (or vice versa) shall be applied.

- Unloading or loading at the lighterage area (Thieng Lieng buoy berths): to be agreed between the port and its customers for each specific case.

- Cargoes packed in big bags or jumbo bag (Group 2): decrease 10% of the rate in III/1/1.2/1.2.1

1.3 Cases for extra charges:

- For cargoes in bags such as fertilizer, gypsum, chemicals, powders, lime, soda ash: increase 20% of the rate in III/1/1.2/1.2.1

- For cargoes dirty, dusty, and smelt such as cement, coal, ore, dried shrimp, fish sauce, animal bones, dried fish, fresh rubber, soda ash in bulk, etc.: increase 30% of the rate in III/1/1.2/1.2.1

- For asbestos, tapioca chips, insecticide, caustic soda, sulphur, cargoes in the nature of acid, gas, inflammable such as fuel oil, korosene, alcohol, ammoniac, clay, etc.: increase 50% of the rate in III/1/1.2/1.2.1

- For steel scraps, stones having to be manually handled with buckets; cargoes in bags having to be cut for stowage: to be agreed for the rate.

- For cargoes pressed, blocked,... having to split or unblock, or pick for unloading or loading: increase 50% of the rate to the volume of cargoes breaking.

- Charges on weighing cargoes (only one time truck with cargo):

+ By motor scale: 0.40 USD/Ton (cargo and truck)
+ By manual scale: 1.00 USD/Ton (cargo and truck)

- For cargoes being unstuffed from container (CFS cargoes): increase 50% of the rate in III/1/1.2/1.2.1

- For cargoes from ship rescued or cargoes damaged, cargoes not-in-order stowed, dangerous cargoes; explosive, flammable, and toxic cargoes such as Nitrates, Nitrocompound, Alkalies, Methane, Magnesium, Nitro cellulose, and products derived from these substances: increase 100% of the rate in III/1/1.2/1.2.1

- For cargoes handling, shifting in the same hold: 50% of the rate for the mode of Ship's hold - Wagon/Truck/Barge (or vice versa).

- For cargoes handling, shifting from one hold to another direct: 70% of the rate for the mode of Ship's hold - Wagon/Truck/Barge (or vice versa); in case of indirectly, through wharf: 120% of the rate for the mode of Ship's hold - Wagon/Truck/Barge (or vice versa).

- For cargoes handling, shifting from one ship to other ship alongside: increase 30% of the rate for the mode of Ship's hold – Wagon/Truck/Barge (or vice versa).

- For cargoes unloaded from barge/lighter, or ship onto truck transported to load on board the other ship (or vice versa): increase 50% of the rate for the mode of Ship's hold - Wagon/Truck/Barge. (Extra charges on hire of truck for transporting and shore crane in use)

- Unloading or loading frozen cargoes (15°C to 0°C): increase 50% of the rate applied; and (under 0°C): increase 100% of the rate in III/1/1.2/1.2.1

*Cargoes with many factors for increasing rate, only highest percentage increase shall be applied.

1.4 Rates of charges on handling means of transportation (Group 7):

(Handling from ship to warehouse/yard, using ship's derricks)

- Car of 4 seats, and light truck under 1.5 MT : 30 USD/Unit

- Car of 8 seats to under 15 seats, forklift under : 40 USD/Unit
5 MT, 20ft trailer .

- Car of 15 to 30 seats and truck under 7 MT, : 50 USD/Unit
refrigerator-truck of 5 MT or under.

- Car of above 30 seats and truck of 7 MT to : 70 USD/Unit
15 MT, forklift of 5 MT and above.

- Refrigerator-truck of above 5 MT, truck of 15 MT : 100 USD/Unit
to 20 MT, concrete-mixed car, tank truck.

- Crawler, excavator, and specialized vehicles not
above prescribed: + Under 15 MT : 100 USD/Unit
+ From 15 MT to 20 MT : 150 USD/Unit
+ Above 20 MT to 30 MT : 200 USD/Unit

- In case using the port's cranes for handling, or tyred-transport means/equipments but these are not to be in operations (no battery power, machine break down,...) having to use the port's tractors, forklifts for moving into the port's warehouses/yards: increase 30% of the rates above prescribed.

- Charges on handling self-movable transport means (except crawler) from ship onto yard (for RORO ship): 50% of the rates above prescribed.

- Tyred transport means/equipments shipped under Liner Terms (unloading from ship to under ship's tackle): 50% of the above-prescribed rate shall be charged to ship-owners.

1.5 Rates of charges on handling over-sized/over-weighed cargoes:

Package being of size/volume not inserted in Group 6, and being of one of the following factors: weight is above 30 MT, length is above 15 m, width is 3.5 m or above, height is 3.5 m or above, shipowner and the port shall negotiate rates for handling as well as rates for leasing crane for each specific case.

2/. Charges on container handling and services:

- Rates in III/2.1 are inclusive of tally charges.

- Handling containers stuffed with dangerous cargoes and oversized containers: increasing 50% of the rates in III/2.1.

- For cargo owners being of the high volume of containers, the General Director shall define reduction or increase of up to 10% of the rates in III/2.1

2.2 Other services

2.2.1 Transshipment containers:

(Unloading containers from ship to CY and then loading on board the other ship at the same port): 150% of the rate as prescribed for the handling mode of "Ship - CY", of which:

- Unloading from ship to CY : 75% of the "Ship - CY"
- From CY to load on board the ship: 75% of the "Ship - CY"

2.2.2 Handling, shifting container in the same ship's hold: 25% of the rate as prescribed for the handling mode of "Ship - CY".

2.2.3 Handling, shifting containers from one hold to another on the same ship (no through wharf): 55% of the rate as prescribed for the handling mode of "Ship - CY".

2.2.4 Handling, shifting containers on the same ship (Unload container from ship onto wharf and the back load containers on board the ship): 100% of the rate as prescribed for the handling mode of "Ship - CY".

2.2.5 Handling containers of dangerous cargoes: 150% of the rate of handling charges.

2.2.6 Lashing or unlashing containers on board: 1.00 USD/Cont.

2.2.7 Unload/load containers with using the port’s crane: charges to be agreed (Minimum rate shall be equal to the rate as prescribed for handling containers with using ship's derricks.

4/. Charges for storage and hiring warehouse/yard:

4.1 Rates of storage charges:

In warehouse/shed:

- Car of 4 seats, light truck under 1.5 MT : 2.50 USD/Unit-Day
- Other kinds of automobiles : 3.00 USD/Unit-Day
- Other cargoes : 0.14 USD/Ton-Day

In open storage :

All kinds of cargoes (except containers) : 0.07 USD/Ton-Day

Notes:

- Duration to be charged for storage defining from the first ton of the whole lot of cargo stored in the port's warehouse/yard. Quantity/volume to be charged for storage shall be based on the actual quantity/volume of cargoes stored in warehouse/yard.

- The above-prescribed rate applied for the first 30 days, if the duration being exceeded storage charges shall be progressively increased as follows:

+ From the 31st to the 45th day : increase 30% of the rate
+ From the 46th to the 60th day : increase 50% of the rate
+ From the 61th day on : increase 100% of the rate

4.2 Rate for hiring warehouse/yard as lumpsum price: to be agreed between the port and its customers.

4.3 Container storage charges:

Time calculated for storage charges: as from container is stored at CY:

- For imported containers (containers unloaded transporting to CY): from the 6th day on.

- For exported containers (containers transported from CY to be loaded on board): from the 4th days on.

- For containers transshipped between different ships, temporary imported/re-exported: from the 4th day on.

Other than the above, time to be charged for storage shall be based on the actual dwell time of container at the port's CY.

- Time to be charged for storage of reefer container: actual time with using the port's electricity. For reefer containers not using the port's electricity shall be charged the same as for conventional containers.

- Rates as above prescribed for storage charges of reefer containers include storage, electricity, and service fees.

5/. Charges on labour waiting and day-work:
- On-waiting worker : 1.00 USD/Hour-Person
- Day work (Technical labour) : 2.40 USD/Hour-Person

6/. Hire of Means/Equipment:

6.1 Hire by timing:

6.1.1 Shorecrane:
- Automobile crane : 30 USD/Hour
- Tower/jib crane : 40 USD/Hour
- Crawler crane : 200 USD/Hour
- Dedicated 80MT crane : 350 USD/Hour

6.1.2 Lift-truck, trimmer/dozer, excavator:
- Lift-truck under 10 MT : 20 USD/Hour
- Lift-truck above 10 MT to 20 MT : 40 USD/Hour
- Lift-truck above 20 MT : 60 USD/Hour
- Trimmer/dozer, excavator : 15 USD/Hour

6.1.3 Floating crane and barge:

- Floating crane (towing not included) : 200 USD/Hour
(Heavy lifts more than 30 MT or 20 meter length: Charges to be agreed).

- Tugboat towing floating crane : 1,000 USD/Trip
(applied in the area of Saigon Port, beyond the area to be agreed)

6.2 Hire by weighing unit:

6.2.1 Dedicated 80MT crane, crawler crane:

- For cargoes of Group 1, 3 : 0.70 USD/MT
- For cargoes of Group 4, 5 : 1.00 USD/MT
- For cargoes of Group 6, 7 : 2.00 USD/MT

6.2.2 Tower/jib crane, automobile crane:
- For cargoes of Group 1 : 0.50 USD/MT
- For cargoes of Group 3 : 0.60 USD/MT
- For cargoes of Group 2 : 0.70 USD/MT
- For cargoes of Group 4, 5 : 1.00 USD/MT

6.2.3 Lift-truck for trimming cargo in hold : 0.70 USD/MT

6.2.4 Truck for transporting cargo in the port's area:
- Conventional cargoes : 0.60 USD/MT
- Oversized/overweighed cargoes : 0.80 USD/MT

6.3 Hire of other means/equipment and other services not above mentioned:

To be agreed between the port and its customers for specific case.
