DECISION No. 49/2005/QD-BGTVT OF OCTOBER 4, 2005, ON THE APPLICATION OF THE INTERNATIONAL REGULATIONS FOR PREVENTING COLLISSIONS AT SEA

THE MINISTRY OF TRANSPORT

Pursuant to the Vietnam Maritime Code of June 14, 2005;

Pursuant to the Government Decree No. 34/2003/ND-CP of April, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the proposal of the director of the Transport Department and the director of the Vietnam Maritime Administration,

Article 1. To apply the International Regulations for Preventing Collisions at Sea, 1972 – Colregs 1972, which was revised in 1981, 1987, 1989, 1993 and 2001 (referred collectively to as the Regulations for Preventing Collisions), enclosed with this Decision (not printed herein).

Article 2. Vietnamese seagoing ships, military ships, public-duty ships, fishing ships, inland waterway crafts, and hydroplanes operating in Vietnam’s seaport waters or seas or the high seas must strictly abide by the Regulations for Preventing Collisions.

Foreign seagoing ships operating in Vietnam’s seaport waters or seas must strictly abide by the Regulations for Preventing Collisions.

Article 3. This Decision takes effect as from January 1, 2006, and replaces Decision No. 1533/QD-VT of August 6, 1991, of the Minister of Transport and Posts, on the application of the Regulations for Preventing Collisions at Sea.

Article 4. The Director of the Office and directors of departments of the Ministry, the director of Vietnam National Maritime Administration, heads of concerned agencies, and relevant organizations and individuals shall have to implement this Decision.
